Another company in Techno park, Collabera Solutions, a software development center has issued pink slips to a number of employees yesterday following the global recession.Just a month back one of the most reputed software companies in Technopark started layoff process by issuing pink slips to a number of employees.
the management of the Collabera Enterprise Software Solutions has denied the reports that the job cuts took place because of Global recession and said the action came after the review of annual performance report.
But see one of the mails sent by an ex-employee of collabera to TechnoparkToday
“layoffs not only in IBS its also there in collabera enterprise software solutions, technoparki’m an ex collaberian who lost the job in the name of global recession. this incident happened on 19th of this month. yesterday HR people called us for a meeting and said thet they are going through tough times and due to the global recession they are not getting the business as usual, and because of that they gonna give us the relieving certificate. they also told us to sign a resignation letter (the letters were already prepared by them). Collabera gave30 minutes time to clear off from the premises.according to my knowledge they laid off around 20 employees.among these employees majority of us joined collabera 6-10 months back. Now i dont know why they are linking this with the performance report”
Is there any code of conduct or thumb of rule for IT companies working in Technopark? or any company can secure some properties and start whatever they want or do any business ?
There is no special code of conduct for IT companies inside technopark. The comapany act and the labour laws are for all companies and there is nothing specific for IT companies
Please remember that technopark is just commercial real estate which is being rented out to IT companies only. If you see the sample agreements between companies and technopark it is similar to any other agreement between landlords and tenants. Nothing more or Nothing less.
Technopark officials responsibility is purely operational and concerned with property management only. They have no mandate to interfere in company affairs or any HR issues.
Employees who believe that taking their compliants to technopark officials is an option are grossly mistaken. There is nothing technopark officials can do with respect to company’s HR policies. If there is anything wrong with the HR policies the department of labour OR the legal system in the country are the only options.
Common mis-understanding regarding technopark:
1. Companies get a tax break when they operate from technopark. This is not true. There is no tax break for operating in technopark. In general if a company registers with STPI (Software Technology Parks of India) it does not have to pay corporate tax on its profits. But you can register with STPI even if you have offices outside of technopark. Only condition is that all work done within the offices is for exports only. Reverse is true for companies within technopark also. So if there is a company within technopark doing business domestically (for example IVL), they cannot claim tax exemption on those profits.
2. GTEC is an organization of all technopark companies. False. GTEC is an organization where some technopark companies are members. Majority of them are not.
3. Rental rates are discounted. False. Most companies are paying market rates. However some large companies like Infosys, TCS and even UST have negotiated with the government to get a discount. It is something that government has done to attract IT majors to kerala.
4. Companies can do any business in technopark. Incorrect. Companies who want to rent or lease technopark space can only indulge in IT or ITES services. For example you cannot rent the space and sell groceries.
What Ravi said is right, but not entirley. Technopark is not a real estate company. Technopark can, on its own, evict any company from the capmus if they find that the company is induging in fradualnt activities, according to them. The company will have the burden to prove otherwise in the court of law.
This is why Collabera employees who are cheated by the managment should complain to Technopark. It appears that there are no real complaints from Collabera employees; they are okay to forefiet the deposits!
Arun,
With due respect, i disagree. Technopark does not have any mandate beyond the rental and leasing business. To your point any landlord can evict their tenants if they believe that they are indulging in illegal activities.
Drawing conclusion that a bad HR policy really amounts to fraud or illegal is a stretch. The question of taking bond money or surety is not illegal. If that is the case even reputed companies like infosys and wipro will be considered fraudulent. These are perfectly legal instruments. Albeit not good or recommended practices in the IT field.
However, the issue here is if the employees have given such money (remember on their own free will) and their employment has been terminated involuntarily, this money has to be returned. Ideally, this needs to be done on the last day of their employment. Being vague and suggesting this is “in the works” long after the employees have been let go is inappropriate…Still not illegal.
Neither you nor me have read the employment contracts so it is difficult to guess if it is a breach of their employment contract.
Finally, the right approach for the employees if they have not been given their money back is to:
1. Send a formal letter demanding the same threatening legal action. Remember in the current scenario no IT company wants to be in the news for the wrong reasons.. Especially if they know the employees are serious
2. If it does not work, approach a decent lawyer and pursue the case. Today the media is very interested in any IT titbits so my guess is Collabera will comply sooner rather than later.
Regarding your suggestion to complain to technopark officials, it will be difficult for these officials to even get an appointment with any reputable IT CEO. As discussed before there is no legal mandate for the technopark officials to interfere in this issue
I have a very close friend, who graduated from Harvard. Worked for ML for over 8 years, recently he’s been “right sized†too, despite of his outstanding performance and the increasing revenue he generated. OMG, now the banking industry is badly hurt, how long it would take for those financial background guys like him get back to the job market. Banking jobs are not there as much as before as easily seen on http://www.joboutlets.com and other job sites in the region
To SureshLiar: There were many wrong HR policies which we both knows and who ever worked in IVL they knows it.. I don’t want to publish the list here. Also i don’t want your wishes to take any resolutions this year..God has given every with good thoughts, mind and brain to face this world under any situations also i also prays to those who lost the job under the name of “poor performers” will also land in a safe place..
Ernst and Young Technopark has started lay off
………….secretly…..
i too heard so, can you give more details? how many, and what is the reason they are telling?
I am going to join the collabera to give technical supprot to one of the US client so can somebody give me right feedback regarding job security.
@Tech_Mgr
Hi sir I just saw your comment on the lay offs in IBS. I am a 2008 batch pass out and got placed in IBS. In the offer letter it was said that our joining date will be on July 2008 and in the July after calling the hr for a lot of time they said us that our joining will be on January 2010 and after that they are sending us e-mails at regular intervals of time to extend our joining date and when ever we called them they told us that they have not taken a decision yet (Also they are giving a personal opinion to go for some other better option if you have) and they are not ready to send an official e-mail on this. We have already wasted our 2 years. At the time of our pass outs there were some other opportunities also but we didn’t try for that because the IBS hr are always telling that will call us
Sir I am not well aware of the IT culture and the things going on in the IT field but can you justify the above policies of IBS hr on freshers, Till now they are not ready to send an official e-mail.
Please reply me Sir,,,,
I dont understand why an Ex-IVLion is so interested? I hope u still have a job. God help u too.
Without a doubt one of the more analytical notations on the subject that i have come across in a while. It is obvious that you have a much enhanced understanding of the matter on hand in comparison with some that has made it uncomplicated for persons such as myself to recognize far more of most of the latest debate that were round .
